2. Opium: The substance mentioned above which is solidified or powdered in any ways, including boiling, exposing to the sun, etc., is called opium. Based on the type of raw material, opium is available with different degrees of concentration and different amount of morphine.

3. Burnt Opium: The substance obtained by dissolving the burnt opium or opium, or Inkjet alone or together or along with other substances in water and boiling them. Like opium and opium sap, Burnt Opium is available with different degrees of concentration and different amount of morphine, based on the type of raw material and the way of producing.

4. Pomace: When the opium sap is obtained, it is filtered for separating impurities. The substance remained from filtering the opium sap is called pomace.

5. Inkjet (burnt sap): A substance obtained from burning the cooked sap that can have different degrees of concentration and different amount of morphine.

6. Any tablet, potion or solution (aqueous or alcoholic) or any syrup containing substances mentioned above.

7. Galen extracts of opium – laudanum – opium extract (liquid or dry), poppy syrup whether prepared in accordance with the French Codex or not.

8. Bhang: Dried flowered or fruited shoots of cannabis plant, whether its resin (hemp juice) is removed or not, whether it is crushed or not, either pure or mixed with other elements.

9. Bhangab (unity Doogh): Mixing bhang with or soaking it in water or other liquids, either pure or mixed with other elements.

10. Hemp (Hashish-Secrets): Resin substance obtained from flowered or fruited shoots of cannabis, either pure or mixed with other elements.

11. Galen derivatives of cannabis, cannabis extract or tincture, hashish.

12. Coca leaf and its Galen extract (powder, extract, tincture).

13. Morphine and its minerals and extracts obtained directly from opium and contain more than 20% of morphine.

14. (Extracts containing morphine, two in a thousand or less, will not be subject to the regulation unless dissolved or diluted in an inactive liquid or solid substance) Morphine esters, morphine anoxides (except for those listed below in Group 2).

Punishment for Drug Abuse in Iran

Drug Law - Iran Tours - Iran Travel - IranvivaIn Iran, penalties are set for different types of drug use and trafficking, based on its amount and its influence, as follows:

Article 1. If anybody smuggles in or out, or attempts to produce, distribute, deal in or put on sale illicit drugs like hemp, bhang, cannabis, hashish, grass, opium, opium sap, burnt opium, pomace, opium or any other types of narcotics or industrial non-medicinal psychedelic drugs listed above, the perpetrators shall be sentenced, according to law, to punishments prescribed hereunder taking into account the quantity of the drugs:

1.    Up to fifty grams: a fine of up to four million rials, along with up to fifty lashes.

2.    More than fifty grams to five hundred grams: a fine of four to fifty million rials, along with twenty to seventy four lashes, and if the court finds it necessary, up to three years of imprisonment.

3.    More than five hundred grams to five kilograms: a fine of fifty million rials to two hundred million rials, plus fifty to seventy four lashes and three to fifteen years of imprisonment.

4.    More than five kilograms: death penalty and confiscation of proceeds (from drug-related crime) or property which corresponds to the value of such proceeds.

Note: If it is established that the perpetrator of the crimes under paragraph 4 of this Article has done the crime for the first time and has not succeeded in distributing or selling narcotic drugs which weigh 20 or less than 20 kilograms, they shall be sentenced to life imprisonment plus seventy four lashes and confiscation of proceeds (from drug-related crime) or property which corresponds to the value of such proceeds. In case the narcotic drugs weigh more than 20 kilograms, the perpetrator shall be sentenced to death penalty under any circumstances.

Article 2. Anybody who buys, keeps, conceals or carries opium and other illicit drugs, mentioned in the previous article, shall be sentenced to the following punishments, taking into consideration the quantity of the drugs and the note under this article:

1.    Up to fifty grams: a fine of up to three million rials, plus up to fifty lashes.

2.    More than fifty grams to five hundred grams: a fine of five to fifteen million rials, plus ten to seventy four lashes.

3.    More than five hundred grams to five kilograms: a fine of fifteen million to sixty million rials, plus forty to seventy four lashes and two to five years of imprisonment.

4.    More than five kilograms to twenty kilograms: a fine of sixty million to two hundred million rials, along with fifty to seventy four lashes and five to ten years of imprisonment, and in case of recidivism all the mentioned punishments shall be implemented plus confiscation of proceeds (from drug-related crime) or property which corresponds to the value of such proceeds, and for the third time, death penalty and confiscation of proceeds (from drug-related crime) or property which corresponds to the value of such proceeds.

5.    More than twenty to one hundred kilograms: a fine of two million rials per kilogram, plus punishments mentioned in previous Article and in case of recidivism, death penalty and confiscation of proceeds (from drug-related crime) or property which corresponds to the value of such proceeds.

6.    More than one hundred kilograms: life imprisonment, plus the fine and lash punishments mentioned in paragraphs 4 and 5 of this Article, and in case of recidivism, death penalty and confiscation of proceeds (from drug-related crime) or property which corresponds to the value of such proceeds.

7.    Anyone who keeps, conceals or carries poppy seeds, poppy stick, coca leaf or cannabis seeds shall be sentenced to a fine of one million to 30 million rials, and one to seventy four lashes. In case of cannabis seeds, the intention to produce narcotics or industrial non-medicinal psychedelic drugs must be established.

Note: If the perpetrators of the above mentioned crimes have operated as a network and transported the narcotics for domestic consumption, they shall be condemned to the punishments of Article 4. Otherwise, they shall be sentenced to the punishments of this Article.

Article 3. If the perpetrators of crimes mentioned in paragraphs 1, 2 and 3 of the Articles 1 and 2 commit the crime, mentioned in the same paragraph or other paragraphs, for the second time, the punishment shall be increased to one and a half times as much as the punishments set forth, and for the third time it shall be increased to twice as much as the mentioned punishments. Flogging punishment for the second time onwards shall be seventy-four lashes at the maximum.

If, as a consequence of recidivism of the crimes under mentioned paragraphs of Article 1, the total amount of the narcotic drugs is more than five kilograms, the perpetrator of the crime shall be sentenced to death penalty and confiscation of proceeds (from drug-related crime) or property which corresponds to the value of such proceeds, and if as a consequence of recidivism of the mentioned crimes in Articles 1 and 2, the amount of drugs exceed 5 kilograms, the perpetrator shall be sentenced to twice as much as the punishments prescribed in paragraph 4 of Article 2.

Drug Policy in Iran 5 - Iran Tours - Iran Travel - IranvivaArticle 4: Anyone who imports, exports, distributes, produces, deals in, keeps or stores, conceals and carries (or transports) narcotic drugs like:

1.    Heroin, morphine, cocaine and other chemical derivatives of morphine or cocaine,

2.    Lysergic acid diethylamide (LSD), Methyl​enedioxy​methamphetamine (MDMA or ecstasy), gamma-Hydroxybutyric acid (GHB), Flunitrazepam,

3.    Amphetamine, Methamphetamine (Crystal),

4.    Other non-pharmacological Industrial psychotherapies or drugs approved by The Parliament of Iran.

shall be sentenced to the following punishments, taking into account the amount of drugs:

1. Up to five centigrams: a fine of five hundred thousand to one million rials, plus twenty to fifty lashes.

2. More than five centigrams to one gram: a fine of two million to six million rials, plus thirty to seventy lashes.

3. More than one gram up to four grams: a fine of eight million to twenty million rials, plus two to five years of imprisonment and thirty to seventy lashes.

4. More than four grams up to fifteen grams: a fine of twenty million to forty million rials, plus five to eight years of imprisonment and thirty to seventy four lashes.

5. More than fifteen up to thirty grams, a fine of forty million to sixty million rials, plus ten to fifteen years of imprisonment and thirty and seventy four lashes.

6. More than thirty grams, death penalty and confiscation of proceeds (from drug-related crime) or property which corresponds to the value of such proceeds.

Note: If it is established that the perpetrator of the crime under paragraph 6 of this Article has committed it for the first time and has not succeeded in distributing or selling the drugs, and the amount of drugs does not exceed 100 grams, or it is not established that the perpetrator has planned to distribute/sell them inside the country, according to the quality and route of transportation, the court shall sentence them to life imprisonment and confiscation of proceeds (from drug-related crime) or property which corresponds to the value of such proceeds.

Article 5. The punishments of the perpetrators of the crimes set forth in paragraphs 1 to 5 of Article 4, in case committed for the second time, shall be one and a half times as much as the punishment mentioned in each paragraph, and in case committed for the third time, shall be twice as much as the punishment mentioned in each paragraph. The punishment of whipping for the second time onwards shall be seventy four lashes at the maximum.

In the fourth time if the total amount of narcotics reaches thirty grams as a consequence of recidivism, the perpetrator is considered as corruptor on earth and shall be sentenced to death penalty. The death penalty, if deemed appropriate, shall be carried out on the premises of their residence and in public.

In case the total amount of narcotics in the fourth time as a consequence of recidivism, does not reach thirty grams, the perpetrator shall be sentenced to a fine of forty to sixty million rials, plus ten to fifteen years of imprisonment and thirty to seventy four lashes.

Article 6. Non-addicts who use non-pharmacological Industrial psychotherapies or narcotic drugs, shall be sentenced to the following punishments, taking into account the type of drugs:

1. For using narcotic drugs mentioned in Article 1, twenty to seventy four lashes and a fine of one million to five million rials.

2. For using the narcotic drugs mentioned in Article 4, fifty to seventy four lashes and a fine of two to ten million rials.

Article 7. Anybody who establishes or runs a place for the use non-pharmacological Industrial psychotherapies or narcotic drugs, they shall be sentenced to a fine of five million to ten million rials, with twenty to seventy four lashes, plus one to two years of imprisonment together with permanent removal from governmental services. The punishment for recidivism of this offence shall be two to four times as much as it is for the first one.

Note: If the place mentioned in this Article is a producing commercial or service unit, in addition to the punishment mentioned in this Article, the approval in principle concerning and the permit for operation of the producing unit and also the business license of the related service and commercial unit shall be suspended for one year, and in case of recidivism of the crime, it shall be confiscated in favor of the government.

Anybody who imports, produces, purchases or sells the equipment and instruments for use or production of narcotics, shall be sentenced to confiscation of mentioned equipment and a fine of one to five million rials, plus ten to fifty lashes.

The perpetrators of keeping, concealing or carrying the instruments and tools of using narcotic drugs shall be sentenced to confiscation of mentioned instruments and a fine of one to five hundred thousand rials for each tool and five to twenty lashes. Antiquities are excluded from the provisions of this Article.

Article 9. Any vehicle transporting narcotic drugs shall be confiscated in favor of the Government, and donated to the discover organization by approval of Drug Control Headquarters. If the vehicle owner is not aware of the transportation of drugs, the vehicle shall be returned to its owner.

Note: Anybody who conceals narcotic drugs in a vehicle to help them be transported, in case the crime is committed, they shall be sentenced to three to six months of imprisonment and a fine of ten to fifty million rials, for conspiracy to commit this crime or other crimes.

Article 10. Anybody who, knowingly and voluntarily, harbors a suspect or fugitive related to this rule or helps them escape or hide before being arrested, shall be sentenced to one-fifth to one-half as much as the punishment set for the main offender.

In case of life imprisonment and death penalty, the perpetrator shall be sentenced to four to ten years, and ten to fifteen years of imprisonment, respectively, plus thirty to seventy four lashes.

Article 11. Anybody who harbors the suspect or fugitive related to this rule or helps them escape or hide after being arrested, shall be sentenced to one-half as much as the punishment set for the main convicted or offender. In case of life imprisonment and death penalty, the perpetrator shall be sentenced to ten years and twenty years of imprisonment, respectively, plus thirty to seventy four lashes.

Article 12. Manufacturing, producing, purchasing, selling, sending maintaining, importing, exporting, using and carrying forbidden narcotics for medical, research and industrial consumptions from the provisions of this Act, by the permission of the Ministry of Health, Treatment and Medical Education, is excluded from the penalty.

Important:  Perpetrators, who are sentenced to death penalty or life imprisonment in this law, are considered as corruptor on earth in any following cases and shall be sentenced to death penalty and confiscation of proceeds (from drug-related crime) or property which corresponds to the value of such proceeds. Otherwise, those who are subject to death penalty shall be sentenced to grade one imprisonment for up to thirty years and a grade one fine of twice as much as the minimum amount, and those who are subject to life imprisonment shall be sentenced to grade two imprisonment and a grade two fine, and in both cases confiscation of proceeds from drug-related crime:

  1. In case a perpetrator or at least one of the partners pulled a weapon during commission of a crime or carried guns in order to deal with the police.
  2. The weapons in this paragraph include stabbing and weapons and ammunition related to the law of punishment of smuggling weapons and ammunition and holders of illegal weapons and ammunition approved in 07/06/1390 (2011 August 29).
  3. In case the perpetrator is the leader, sponsor or investor, or uses children, teenagers younger than eighteen years of age, or lunatics to commit a crime.
  4. In case the perpetrator has definitely been sentenced to death penalty, life imprisonment or imprisonment for more than fifteen years for committing any of crimes covered by this law.

Article 13. Anybody who, knowingly and voluntarily, manufactures, purchases, sells, maintains, carries, imports, exports and supplies industrial/chemical substances such as acetic anhydride, anthranilic acid, phenylacetic acid, acetyl chloral and other substances mentioned in the Tables I and II of attached to Article 12 in United Nations Convention against Illicit Trafficking in Narcotic Drugs and Psychotropic Substances, 1988, and related amendments or try to import, purchase, sell, manufacture, maintain and export codeine or methadone in order to produce or convert into narcotic drugs shall be sentenced to punishments mentioned in Article 2, based on the amount of illicit drugs.
